Of course. I'd change this construct to:
   declare
      empty : Array_Type (Offset_Type'Last ..
                          Offset_Type'Base'Pred(Offset_Type'Last));
   begin
      return empty;
   end;

But really in the case of generics, I don't expect such functionality.
Requireing an generic empty variable is more approbriate.
