There have certainly been civil lawsuits over whether a vendor's Bill-of-Materials software did or did not perform up to specification. If I were on a jury regarding a faulty concrete pour, I would certainly want to take into account the degree to which checking was involved in the use of the concrete, and I would be impressed if there were concrete that would turn blue if improperly cured.
