It makes sense, since binary compatibility is achieved by having exactly the same hardware: one of the CPU in DS is the same as GBA (arm7), the 2D GPU is also the same (except DS has one for each screen), A and B buttons are wired exactly the same way, etc. But you still have the problem of deploying your code in the device, with dedicated hardware that has similar legal and availability issues as DS flashcarts.
