Copyright is odd in that it's strict liability. If you had access, and you copied someone elses material without permission, then it is not a defence to say you could not have known it was copyrighted. Furthermore, the penalty is statutory, and you do not have to show economic harm. For an example, consider the case against mp3.com, where they were assessed the statutory penalty for each ripped CD, and the plaintiff did not bother to even claim, let alone show, economic damage.
